Kimberly Carter and Susan Gross Sholinsky of Epstein Becker Green will present an in-person and virtual session on conducting effective workplace investigations.
This session is designed to guide employers in effectuating a legally sufficient investigation that can serve as a defense against legal claims, such as harassment and discrimination. You will learn how to classify a complaint in order to determine whether an investigation is warranted, and if so, who should conduct the investigation.
The program will provide guidance on questions such as who to interview, in what order, what types of questions to ask, and how to address confidentiality and legal privilege. It will also address tricky issues such as how to address reluctant witnesses and what to do if the target demands their attorney be present.Participants will also be provided with strategies for documenting the process in the most helpful way.
